US Court Mandates Release of Abrego Garcia from ICE Detention
A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment is without lawful basis.
"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.
The case stems from a mistaken removal to El Salvador earlier this year, which US authorities later acknowledged was an mistake. After his return to the United States to answer alien smuggling charges, he was held in immigration detention.
In her order, the judge pointed out that the authorities does not have a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."

The legal proceedings center on disputed assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.
He has also pleaded not guilty to the smuggling counts, which are part of a ongoing trial in the state of Tennessee.
